1. Agreement to Terms

By accessing or using the Bousquet Mountain website (bousquetmountain.com), purchasing any ticket, pass, lesson, rental, or program, entering our premises, or subscribing to our communications, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

These Terms apply to all visitors, guests, pass holders, program participants, and others who interact with Bousquet Mountain Ski Area, Inc. (“Bousquet Mountain,” “we,” “us,” or “our”). Our Privacy Policy and Our Policies page are incorporated by reference and should be reviewed alongside these Terms.


2. Assumption of Risk & Massachusetts Ski Safety Act

2.1 Inherent Risks

Skiing, snowboarding, snow tubing, and all other winter recreational activities involve inherent risks. Under the Massachusetts Ski Safety Act (M.G.L. Chapter 143, §§ 71N–71S), participants are presumed to know the range of their own abilities and accept the risks inherent in these sports, including but not limited to:

  • Variations in terrain, steepness, and slope design
  • Ice conditions, bare spots, and changing snow conditions
  • Weather conditions, including reduced visibility
  • Collisions with lift towers, signs, posts, fences, hydrants, water pipes, or other structures
  • Collisions with other skiers, snowboarders, or tubers
  • Falls and loss of control
  • Risk of severe injury or death

2.2 Operator Duties

Bousquet Mountain operates its facilities in a reasonably safe condition as required by Massachusetts law. Our duties include: marking trails, designating open and closed terrain, properly marking obstructions, and maintaining lifts in accordance with applicable safety regulations. However, Bousquet Mountain is not liable for damages arising out of the risks inherent in the sport of skiing.

2.3 Skier & Guest Responsibilities

All guests must:

  • Ski or ride within the range of their own ability and maintain control of speed and course at all times
  • Yield to other skiers and persons downhill
  • Obey all posted trail signs, closures, and instructions from Bousquet Mountain staff and Ski Patrol
  • Not ski on any slope or trail that has been designated closed
  • Attach safety straps or retention devices to prevent runaway equipment
  • Not board or disembark a lift except at designated locations
  • Report any collision involving injury to Ski Patrol before leaving the area

2.4 Snow Tubing

Snow tubing is a separate activity with its own inherent risks, including high speeds, loss of control, collision with other tubers or barriers, and falls while loading or unloading. Guests participating in snow tubing accept these risks. Children must meet height and age requirements as posted. All tubers must follow staff instructions at all times.

2.5 Notice of Claim

Pursuant to M.G.L. Chapter 143, § 71P, no action shall be maintained against a ski area operator for injury to a skier unless, as a condition precedent, the injured person provides written notice to Bousquet Mountain within ninety (90) days of the incident.


3. Tickets, Season Passes & Purchases

3.1 Pricing and Availability

All prices are subject to change without notice. Lift ticket and program prices vary based on age, time of day, day of week, and season. The price displayed at the time of purchase is the confirmed price for that transaction.

3.2 Refund & Cancellation Policy

All ticket and pass purchases are non-refundable and non-transferable, except as described in our Policies page or as required by Massachusetts law. Bousquet Mountain does not issue refunds due to weather conditions, reduced terrain, or personal changes in plans. Please review our full refund policy on our Policies page before purchasing.

3.3 Season Pass Terms

Season passes are non-transferable and may only be used by the named passholder. Photo identification may be required. Misuse of a season pass — including sharing or transferring — will result in revocation without refund. Season passes are valid for the specified season only and expire at season’s end.

3.4 No Guarantee of Operations

Bousquet Mountain does not guarantee specific trail counts, lift operations, snow conditions, terrain availability, parking, weather, or road conditions. Operational hours and open terrain are subject to change based on weather, equipment maintenance, and safety considerations.


4. Rentals, Lessons & Programs

Rental equipment is available on a first-come, first-served basis. Pre-booking does not guarantee specific equipment availability. Rental equipment must be returned in the same condition it was issued. Guests are responsible for any damage caused by negligence or misuse beyond normal wear.

Participation in lessons or programs (including but not limited to Ski School, Slope Sisters, BAR League, and youth programs) requires compliance with all instructor directions. Bousquet Mountain reserves the right to dismiss any participant whose behavior endangers themselves or others, without refund.


5. Guest Conduct & Resort Rules

Bousquet Mountain is a family-friendly environment. All guests are expected to behave in a respectful and safe manner. Bousquet Mountain reserves the right to revoke access or remove any person from the premises without refund for:

  • Skiing, boarding, or tubing beyond their ability in a reckless manner
  • Skiing on closed trails or restricted areas
  • Harassment, threatening behavior, or abusive language toward staff or other guests
  • Use of alcohol or substances that impair safe participation
  • Tampering with equipment, lift infrastructure, or safety signage
  • Any other conduct deemed unsafe or disruptive by management

6. Website & Online Services

6.1 Acceptable Use

You may use our website for lawful purposes only. You agree not to use the site to transmit any harmful, unlawful, or deceptive content; attempt to gain unauthorized access to any portion of our systems; or interfere with website functionality. We reserve the right to terminate access at any time.

6.2 Accuracy of Information

We make reasonable efforts to keep information on our website accurate, but we do not warrant that content is complete, current, or error-free. Hours, pricing, conditions, and event information are subject to change. Always check current conditions before visiting.

6.3 Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. Bousquet Mountain does not endorse, and is not responsible for, the content or privacy practices of any third-party site.

6.4 Intellectual Property

All content on bousquetmountain.com, including text, images, graphics, logos, and videos, is the property of Bousquet Mountain or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.


7. Mobile & SMS Text Messaging Terms

This section governs Bousquet Mountain’s SMS/text messaging program and is compliant with CTIA Short Code Monitoring Handbook standards and applicable carrier requirements, including programs operated via Twilio.

Bousquet Mountain Alerts

1. Program Description

Bousquet Mountain Alerts is a recurring SMS/MMS messaging program. When you opt in, you will receive messages including: mountain condition and snow reports, season pass promotions and renewal reminders, event announcements, lift and terrain updates, program reminders (Ski School, Slope Sisters, BAR League, tubing, and youth programs), and other operational alerts relevant to your Bousquet Mountain experience. Message frequency varies based on season and operational activity.

2. How to Cancel (Opt Out)

You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

4. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. You will receive recurring messages; frequency varies by season. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

6. Privacy

7.7 Consent & TCPA Compliance

By providing your mobile phone number and opting in — via our website, a form submission, or by texting a keyword — you expressly consent to receive autodialed and manually dialed marketing and informational text messages from Bousquet Mountain. Consent is not a condition of any purchase. Our program is operated in compliance with the Telephone Consumer Protection Act (TCPA), applicable FCC regulations, and CTIA Short Code Monitoring Handbook standards. We do not send marketing text messages before 8:00 AM or after 9:00 PM in the recipient’s local time zone. All opt-out requests are honored promptly.

7.8 Supported Carriers

Supported carriers include, but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, U.S. Cellular, and other major wireless providers. Text messaging services may not be available on all mobile devices or through all carriers.


8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOUSQUET MOUNTAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OUR SERVICES OR WEBSITE.

In no event shall Bousquet Mountain’s total liability to you exceed the amount paid by you to Bousquet Mountain for the specific product or service giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under Massachusetts law.


9. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of Bousquet Mountain’s facilities or services shall be subject to the exclusive jurisdiction of the courts of Berkshire County, Massachusetts.


10. Changes to These Terms

Bousquet Mountain reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services following any changes constitutes your acceptance of the revised Terms.

Amanda Cozzaglio

Amanda started at Bousquet in September, 2022.

She was born and raised in the Berkshires and currently resides in Pittsfield. She loves to be outside in the summer months hiking the various trails we have to enjoy, biking on the Rail Trail or kayaking anywhere there is water. Although she enjoys the warm weather over the cold, she is excited to appreciate the winter beauty on a whole other level and brush up on her skiing skills!

When Amanda is not working, she thoroughly enjoys spending time with her family (mainly her 5 nephews and 1 sweet little niece 😊)

Yaron Steinhauer

Yaron’s been in the Snowsports industry for 20 years, starting out as an instructor at Hunter Mountain. He leveled up with his Level 3 PSIA certification, then headed out west for a bit. Now he’s back east and has been our Operations Manager since the summer of 2023! He’s all about sharing his passion for the sport and making sure everyone enjoys their time on the snow.

Originally from Westchester County, NY, he’s now hanging out in the Berkshires, and if he’s not on the slopes, he’s probably biking around the hills (especially in the summer).

Eliza Lindberg

Eliza, a native of Canaan, NY, has been skiing since she could stand on two feet, and deeply loves the outdoors. After getting her Bachelor’s in Psychology in 2023, she joined the Bousquet team filled with passion for skiing, enthusiasm, and curiosity.

Her investment in Bousquet extends beyond the slopes, recognizing it as a gathering place that fosters community connections, promotes healthy living, and plays a significant role in sustaining the vibrant culture of Berkshire County.

Michael Sheinkman

Michael joined the Bousquet Snowsports team following retirement from a 30 year career responding to disasters and humanitarian crises around the world with the United Nations and the US government. He first started skiing at 5 years old, improving his skills during family trips to Vermont. Michael currently holds PSIA certifications as a Level 1 Ski Instructor and Children’s Specialist and has instructed professionally at Bousquet, Catamount, and Killington.
 
Beyond Bousquet, Michael enjoys cross-country skiing, hiking. bicycling, swimming, and SCUBA diving.
 
Favorite trail: Grand
